58yo M’sian Fined RM3,000 for Making Lewd Comments Online About Dr Amalina’s Baby Girl

An oil palm worker was fined RM3,000 by the Sessions Court in Sepang, Selangor, on charges of posting obscene comments about Malaysian-born surgeon Dr Amalina Che Bakri’s baby girl, 3 years ago.

According to a report by Harian Metro, Judge Ahmad Fuad Othman handed down the sentence to 58-year-old Ahmad Nasir Kadiri, after he pleaded guilty to the charge. He was also ordered to serve a 6-month jail sentence should he fail to pay the fine.

Based on the charge, he used Facebook to knowingly make and initiate the transmission of obscene comments with the intention of hurting others. Before handing down the sentence, Judge Ahmad Fuad advised Ahmad Nasir to be more cautious when making comments on social media, as every action taken has consequences.

“When the phone is in our hands, we can make various comments, we can slander or defame anyone. For example, your offence today, everything is monitored by MCMC (the Malaysian Communications and Multimedia Commission),” he said.

 

What happened in court

Considering the lewdness of Ahmad Nasir’s actions, MCMC Deputy Public Prosecutor, Fadhli Ab Wahab, requested that the court impose a deterrent and instructional sentence so that he, as well as the community, would not repeat the same offence.

“He should be given a lesson and a warning not to arbitrarily use social media as a platform to express obscene matters. If we look at the facts of the case presented, the comments were made against a baby who could not speak, but the baby’s mother (Dr Amalina) filed a complaint with MCMC,” he said.

He then asked that the court consider the current sentencing trend under Section 233, which imposes a fine of between RM7,000 and RM9,000 for offences related to obscene comments.

Ahmad Nasir, who was not represented by a lawyer, appealed for a lighter sentence on the grounds of being underprivileged and supporting a child who is still studying in university.

“I appeal, this is my first offence, in the name of Allah, I promise not to repeat this useless action again.”
