Drunk 25yo BMW Driver Pleads Not Guilty to Killing Man in Johor Crash, Seeks Lower Bail as He Has Parents to Care For

A drunk 25-year-old BWM driver recently ran over a man who stopped by the road to help an injured motorcyclist. Following the crash, the man was pronounced dead at the scene. The accident took place at Kilometer 16 of the Johor Bahru-Kota Tinggi Road at 2.10 AM on April 13.

The drunk driver, Kok Zi Kang, pleaded not guilty at court today (April 16)

According to the charge sheet, the accused is charged with driving a BMW530i with a blood alcohol level of 76mg/100ml, which is 26mg/100ml above the prescribed limit of 50mg/100ml, causing the death of Mohd Taufik Arif Sariff, 37, who worked as a food delivery rider.

Kok was charged under Section 44(1)(b) of the Road Transport Act 1987 (Act 333). If convicted, Kok will not only be banned from driving but will also face jail time of up to 15 years with a fine of up to RM100,000.

Additionally, Kok, who was represented by lawyer Chuah Shyue Chien was also charged under Section 108(3)(f) of the Road Transport Act (RTA) 1987 for displaying a vehicle registration number that did not belong to the vehicle that he was driving during the accident.

If found guilty, Kok can be fined up to RM20,000 or face a prison sentence of 5 years, or both.

 

Asking to reduce RM25,000 bail

Public Prosecutor Amirah Tasnim requested the Johor Bahru Magistrate Court to set a bail of RM25,000 for both charges with one surety and three other conditions, namely,

  • Reporting himself to the police station every month
  • Surrendering his passport to the court
  • Suspend his driver’s license until the case is resolved

Chuah, on the other hand, requested the court to lower Kok’s bail. This is because Kok has to take care of his parents with his monthly income of RM4,000 as a workshop employee.

The court then set bail at RM8,000 with one surety, and the three conditions set by prosecutor Amirah Tasnim, reported Sinar Harian.

The case has also been set to a mention for submissions of documents on May 19, 2025.
