HR Ministry: Employers Must Pay Public Holiday Rates Or Provide Replacement Leave To Those Working This 28 Nov

As announced by our new Prime Minister Datuk Seri Anwar Ibrahim, Malaysians will be enjoying public holiday this Monday (28 November 2022) in conjunction with the formation of the new Unity Government. Now, the Human Resources Ministry has given more details on the public holiday, saying that private sector employers are required to discuss with their employees whether they wish to take the public holiday on Monday or replace it with another day.

According to Bernama, the ministry urges for employers to fulfil the award of the additional public holiday for workers. Moreover, in a statement yesterday, the ministry also clarified that those required to work on Monday without a replacement rest day should be paid wages based on the rate for a public holiday.

The additional public holiday this 28 November was declared under Section 8 of the Holidays Act 1951 (Act 369), which is also a public holiday allocated for private sector workers under Section 60D (1)(b) of the Employment Act 1955. The Prime Minister originally proposed to declare public holiday yesterday (25 November 2022) but changed it to Monday instead so as to give space for the Ringgit and Bursa Malaysia to continue their rallies.
