A Nigerian private college student pleaded not guilty at the Magistrate’s Court yesterday (April 30) to charges, including biting off a police officer’s ear during an incident last Friday (April 25).
The accused, 38-year-old Okenyehike Kelvin Obianke, claimed he didn’t do it on purpose, according to Sinar Harian.
He bit off the officer’s left ear
During proceedings before Magistrate Mageswary, the accused was first charged with intentionally causing grievous injury to Corporal Danierul Azraq Ahmad Khair, 36, by biting off his left ear in front of a clinic in Metro Prima, Kepong, at around 10:10 PM on April 25.
He was charged under Section 325 of the Penal Code, which carries a prison sentence of up to seven years and a fine upon conviction.
Before Magistrate Atiqah, he faced two additional charges for entering the country without valid travel documents under Section 6(1)(c) of the Immigration Act 1959/63, which is punishable under Section 6(3) with a fine of up to RM10,000, imprisonment of up to five years, or both, as well as up to six strokes of the cane if convicted.
For the third charge, he was accused of self-administering a dangerous drug (benzodiazepine) in the toilet of the Narcotics Criminal Investigation Department office at the Sentul District Police Headquarters at 3 AM on April 26.
The charge was made under Section 15(1)(a) of the Dangerous Drugs Act 1952, which carries a fine not exceeding RM5,000 or imprisonment for up to two years, if convicted.
He was denied bail
The prosecution was led by Deputy Public Prosecutors Nur Farhana Mohamad Poad and Nurainizatul Farhana Zainal, while the accused, an undocumented foreigner, was not represented by a lawyer.
Magistrates Mageswary and Atiqah denied bail and set the next hearing dates for June 10 and July 23 to allow for document submission and the appointment of legal counsel.
