Myvi Driver Who Caused The Death Of Police Officer Punished With 8 Years Jail & RM30,000 Fine

The Myvi driver responsible for the death of a police officer on 1 November in Johor has been sentenced to eight years in prison and fined RM30,000 by the Magistrate’s Court for dangerous driving resulting in death.

The accused, Mohamad Syafiq Lokman, 25, pleaded guilty after the charge was read out by Magistrate Mohd Zaki Abd Rahman, reported Harian Metro.

In the same charge, he was also disqualified from having a driving licence for up to five years and if he failed to pay the fine, he would have to serve 12 months in prison.

This is the first case that was imposed a heavier sentence according to the new amendment of Section 41(1) of the Road Transport Act 1987, which states that the accused can face a maximum jail term of 10 years, a maximum fine of RM50,000 and disqualification of licence for up to five years for the first conviction.

In a second charge, Mohamad Syafiq was ordered to pay a fine of RM1,800 for not having a driving licence at the time of the incident according to Section 26 (1) of the Road Transport Act 1987. Failure to pay the fine would result in three months jail.

In a separate court, Mohamad Syafiq received a third charge for deliberately obstructing a civil servant from carrying out their duties by refusing to stop the vehicle as instructed by the police at the time of the incident. He was sentenced to another 12 months in jail separately and fined RM5,000.

In a fourth charge, Magistrate Nurasidah Rahman also ordered the accused to be jailed for another eight months separately and to carry out a supervision order for two years, for the offence of inserting drugs into the body, according to Section 15 (1) (a) of the Dangerous Drugs Act 1952.

Second accused 

The second person to be charged in regards to this incident was Siti Noor Ashikin Muhammad Arifin, 26, who was sentenced to eight months jail and fined RM1,000 for allowing her boyfriend to drive her vehicle even though he did not have a driver’s licence.

Magistrate Mohd Zaki Abd Rahman made the decision after Siti Noor Ashikin pleaded guilty to the charge.

Siti Noor Ashikin was also sentenced to eight months jail and a two-year supervision order for the offence of inserting amphetamine and methamphetamine into the body.

Third accused 

Meanwhile, her boyfriend, Muhamad Syahrihudin Abdul Majid, 24, was fined RM1,000 for not having a driver’s licence. Failure to pay the fine would result in three months jail.

Fourth accused 

A fourth individual involved in this incident was a friend who was also in the Myvi during the accident. Muhamad Aiman Romli, 24, was sentenced to eight months jail for inserting amphetamine and methamphetamine into the body.

The case was handled by Johor State Prosecuting Director, Tengku Amir Zaki Tengku Abd Rahman and Deputy Public Prosecutor Noridayu Md Kassim while all the accused were not represented by a lawyer.

In the incident, Constable Nicholester Dadup, 20, was killed while his colleague, Lance Corporal Mohd Fadhirul Musa, 32, who was the driver was seriously injured.

Following incident, all four of the suspects tested positive for drugs.
